BYD’s Patent Defense: How a Chinese Automaker Protects Its Independent Innovation

In recent years, BYD, a new energy vehicle brand, has risen rapidly in the global market. At the same time, many infringing imitations appeared. Some competitors copied its battery and electronic control technologies and vehicle designs. They mislead the market and hurt the innovative achievements built by the brand over years.
这场知识产权纠纷的核心，是刀片电池等核心新能源技术专利的争夺。比亚迪在研发早期，就提交了大量发明专利申请。但是很多同类企业试图绕开专利保护范围，擅自借鉴其核心技术，这让比亚迪的维权之路困难重重。
The core of this intellectual property dispute is patents for core new-energy technologies such as the Blade Battery. BYD applied for many invention patents at the early stage of research. However, many peer companies tried to bypass patent protection and use its core technology without permission. This made the protection process tough.
很多人会疑惑：自主研发的技术，是不是自动拥有专利保护？答案是否定的。专利权，需要国家知识产权局审查授权之后，才正式生效。单纯研发出新技术，不等于获得专利保护。
Many people wonder: if a technology is independently developed, does it automatically get patent rights? The answer is no. Patent rights only take effect after examination and authorization by the China National Intellectual Property Administration. Developing new technology alone cannot get patent protection.
面对层出不穷的技术侵权，比亚迪选择拿起法律武器，发起批量维权诉讼。它起诉侵权企业，要求对方停止使用侵权技术、赔偿经济损失。
Faced with constant technology infringements, BYD chose to take legal action. It filed many lawsuits against infringing companies, asking them to stop using stolen technology and pay compensation.
但维权并不轻松。知识产权案件有一个难点：判断产品技术是否落入专利保护范围。法官会综合技术结构、工作原理、实现效果，判断该技术是否构成侵权。很多侵权企业会改动少量技术细节，企图钻法律空子。
But it is not easy to win. The hard part of IP cases is judging whether product technology falls within patent protection scope. Judges check technical structure, working principle and practical effects to decide if infringement exists. Many infringing firms change minor technical details to avoid punishment.
对于国产科创企业来说，专利布局一定要走在产品推向市场之前。在项目研发的初期，就要规划国内外专利申请，提前防范技术抄袭与专利抢注的漏洞。
For domestic innovative enterprises, patent planning should come before launching products. When a project is first developed, companies should apply for patents at home and abroad to stop technology copying and patent squatting.
企业的核心技术、产品设计、创新方案，共同构成科创企业的价值。专利就是守护这份创新价值最基础的盾牌。
